EASA Part 21G Changes Related to Commission Delegated Regulation (EU) 2023/1028 of 20 March 2023

Sofema Online (SOL) www.sofemaonline.com is considering changes to the regulatory requirements concerning EASA Part 21 G Production Organisation Approval.

These changes aim to streamline the approval process for production organisations while maintaining high safety and compliance standards in the aerospace manufacturing sector.

•  Demonstration of Capability:

Production organisations must prove their capability to manufacture products, parts, and appliances in accordance with Annex I (Part 21), except for those items eligible for installation in type-certified products without needing an EASA Form 1.

• Non-Member State Manufacturers:

Manufacturers located outside of member states can demonstrate capability by holding a certificate from their state, provided that the state has a compliance checking system equivalent to the EU's and is recognized by EASA.

• Pre-2003 Approvals:

Production organisation approvals that were issued or recognised by a member state before 28 September 2003, in accordance with JAA requirements, are deemed to comply with this regulation.

• Exemptions from Environmental Protection Requirements:

Organisations may apply for exemptions from specific environmental protection requirements outlined in Regulation (EU) 2018/1139.

• Correction Period for Non-compliance Findings:

Organisations have until 7 March 2025 to correct any non-compliance related to Annex I requirements introduced by Commission Delegated Regulation (EU) 2022/201. Failure to correct these findings may result in revocation, limitation, or suspension of the approval certificate.

• Exemption for Organisations with a Letter of Agreement:

Organisations that produce products, parts, or appliances without an approval certificate but hold a valid letter of agreement issued before 7 March 2023 are exempt from complying with specific Annex I requirements introduced by Delegated Regulation (EU) 2022/201.

• Alternative Demonstration of Capability for Member State Entities:

Entities based in a Member State can alternatively demonstrate their capability according to Annex Ib (Part 21 Light), particularly for manufacturing activities specified under certain conditions.

• Specific Manufacturing Activities Exemptions:  

The regulation specifies exemptions from the demonstration of capability for the manufacture of parts or appliances that do not require an EASA Form 1 for installation in type-certified products, parts eligible for installation in aircraft subject to a declaration of design compliance, and the manufacture of aircraft and parts under Article 2(3).
